By creating an account, purchasing a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
To use the Service, you must be at least 18 years old, or the age of legal majority in your jurisdiction, and capable of entering into a legally binding agreement. By registering for an account, you confirm that you meet these requirements and that any information you provide — including your name, email address, and billing details — is accurate, current, and complete.
You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any API keys issued to you. You must notify us immediately at service@safestproxy.com if you become aware of any unauthorized use of your account. SafestProxy is not liable for any loss or damage arising from your failure to safeguard your credentials.
You may not create an account on behalf of another person or entity without authorization, and you may not maintain more than one active account except where a specific plan or agreement expressly permits it.
SafestProxy provides proxy network infrastructure — including residential, datacenter, and mobile proxy access — together with a client dashboard for managing subscriptions, monitoring usage, generating credentials, and handling billing. The Service is intended to give businesses and individuals a reliable way to route web traffic for purposes such as market research, price monitoring, brand protection, and data aggregation.
We continually work to improve the Service, which means the specific IP pools, geographic coverage, bandwidth allowances, response speeds, and dashboard features available to you may change over time. We may add, modify, suspend, or discontinue any feature or plan at our discretion, and — where reasonably possible — we will provide advance notice of changes that materially reduce the functionality you are paying for.
Nothing in these Terms guarantees a specific level of uptime, IP availability, or performance unless such a commitment is set out separately in a written service-level agreement between you and SafestProxy.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party. Without limiting the generality of the foregoing, you must not use the Service, or permit it to be used, to:
You are solely responsible for ensuring that your specific use case — including any web scraping, automation, or data collection activity — complies with the terms of service of any third-party website you access, as well as applicable data protection and computer-misuse laws in your jurisdiction.
Key point: Violating this Acceptable Use Policy may result in immediate suspension or termination of your account without refund. Where required by law or by a valid legal request, we may disclose relevant account and usage information to affected parties, payment processors, or law enforcement authorities.
Paid plans are billed in advance on a recurring (monthly or annual) basis, or on a usage basis, as described on our pricing page or at checkout. By providing a payment method, you authorize us — or our payment processor — to charge that method for all fees associated with your selected plan, including applicable taxes.
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your dashboard; cancellation will take effect at the end of your current billing cycle, and you will retain access to the Service until that date.
Unless otherwise stated on our pricing page or agreed in a separate written arrangement, fees are non-refundable once proxy access or bandwidth has been provisioned to your account, including in cases of partial-month cancellation or unused bandwidth. Failed or disputed payments may result in a temporary suspension of your account until the balance is resolved.
We may change our pricing or plan structure at any time. Where a change affects an existing subscription, we will provide reasonable advance notice, and the updated pricing will take effect at your next renewal.
The Service — including its underlying software, network architecture, dashboard design, documentation, and all associated trademarks, logos, and brand assets — is owned by SafestProxy or its licensors and is protected by applicable intellectual property and unfair-competition laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business or personal purposes, subject to your compliance with these Terms. You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works based on the Service, except to the extent such restriction is prohibited by applicable law.
The Service is commonly used alongside third-party browsers, automation frameworks, browser-fingerprinting tools, and workflow platforms. SafestProxy does not control, and is not responsible for, the availability, content, security practices, or terms of any third-party website, tool, or service that you access or interact with through our proxy network.
Any data you collect, store, or process using the Service — including data obtained from third-party websites — is your sole responsibility. You are responsible for ensuring that your collection and use of such data complies with applicable privacy and data-protection laws, including obtaining any consents required from data subjects.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any IP address, geographic target, or bandwidth allocation will remain continuously available.
You acknowledge that proxy and internet infrastructure can be affected by factors outside our control, including upstream provider outages, target-website blocking, and changes to third-party network policies.
To the maximum extent permitted by applicable law, SafestProxy — including its officers, employees, and affiliates — shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any and all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you actually paid to SafestProxy in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless SafestProxy, its officers, directors, employees, and business partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any data collected or activity conducted through your account.
You may cancel your account and stop using the Service at any time through your dashboard settings. Upon cancellation, your access will continue until the end of your current billing period, after which your account and associated data may be deactivated in accordance with our data-retention practices.
We may suspend or terminate your access to the Service, with or without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, failed to pay applicable fees, or posed a security or operational risk to the Service or other users. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply after your account is closed.
These Terms are governed by, and will be construed in accordance with, the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, USA, and you consent to the personal jurisdiction of those courts, unless applicable consumer-protection law requires otherwise.
We may revise these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or through a notice in your dashboard. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those changes; if you do not agree, you must stop using the Service.
